Florida Statute 893.13 prohibits the sale, manufacture, or delivery of a controlled substance, and the possession with the intent to sell, manufacture, or deliver, a controlled substance. In other words, you can be charged with a drug offense if law enforcement has probable cause that you were in possession of a controlled substance or possessed a controlled substance with intent to sell. The maximum and minimum penalties depend on how the drug is scheduled and, in some cases, where the incident occurred.
These crimes can be classified as a first-degree felony, a second-degree felony, a third-degree felony, or a first-degree misdemeanor.
